Agreement to these terms

These Terms of Service form an agreement between you and Madrina. They apply when you access or use Dash by Madrina, madrinai.com, our account and licensing services, and related support (together, the “Services”). By using the Services, you agree to these terms. If you do not agree, do not use the Services.

You must be legally able to enter this agreement. If you use the Services for an organization, you represent that you have authority to bind that organization.

What Dash provides

Dash is a workspace for Mac with companion access on supported iPhone and iPad devices. Features may require a configured Mac, compatible operating systems, a local network, supported third-party accounts, or an internet connection. Availability can vary by device, location, release, and configuration.

Dash may let you connect independent services such as AI providers. Those services are provided under their own terms and privacy policies. You are responsible for your accounts, credentials, usage, and charges with those providers. Madrina does not guarantee a third-party service’s availability, output, accuracy, or conduct.

Accounts and security

You are responsible for the information submitted through your account and for keeping sign-in credentials, license numbers, redemption links, pairing codes, and API keys secure. Do not share them with anyone who is not authorized to use your account or devices. Notify us promptly if you believe your account or license has been compromised.

You may use the Services only in compliance with applicable law. You may not interfere with the Services, bypass access or licensing controls, probe or exploit vulnerabilities, distribute malware, misuse another person’s account or data, or use the Services to violate another person’s rights.

Software and Forever License

Subject to these terms and payment of the applicable price, Madrina grants you a limited, personal, non-exclusive, non-transferable, and revocable license to use Dash on supported devices you own or control. The Forever License is a one-time purchase that provides lifetime access to the purchased Dash software and supported companion experiences for the same person. It is not a subscription.

“Lifetime” refers to the commercial life of the applicable product and does not guarantee that every feature, third-party integration, device, or operating-system version will remain available forever. Mac hardware, internet access, and third-party services or API usage are not included.

Except where law permits otherwise, you may not copy, resell, sublicense, rent, reverse engineer, or create derivative works from the Services. Madrina and its licensors retain all rights not expressly granted to you.

Payments, taxes, and refunds

Prices and applicable taxes are shown before purchase. Apple manages billing and refund requests for purchases made through Apple. Stripe and RevenueCat support website checkout, licensing, and purchase records. For website purchases, contact dan@madrinai.com with your receipt or order identifier to request help or a refund review.

Refunds and statutory cancellation rights are handled according to the purchase channel and the laws that apply to you. Nothing in these terms limits non-waivable consumer rights.

Your content and responsibilities

You retain your rights in content you use with Dash. You are responsible for having the rights and permissions needed to use that content and for reviewing actions or output before relying on them. You authorize Madrina to process information only as needed to provide, secure, maintain, and support the Services, as described in our Privacy Policy.

AI and automated systems can make mistakes. Do not rely on their output as a substitute for professional judgment, and do not use the Services for decisions where an error could cause serious harm without appropriate human review and safeguards.

Changes and availability

We may improve, modify, suspend, or discontinue features to maintain security, comply with law, respond to third-party changes, or develop the product. We will provide notice when required by law. We may also update these terms; the updated version will be posted here with a new effective date.

Suspension and termination

You may stop using the Services at any time. We may suspend or terminate access if you materially violate these terms, create a security or legal risk, or misuse the Services. Where reasonable, we will give notice and an opportunity to address the issue. Provisions that by their nature should survive termination—including ownership, disclaimers, liability limits, and dispute terms—will survive.

Disclaimers

To the fullest extent permitted by law, the Services are provided “as is” and “as available.” Madrina disclaims implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not promise that data, previews, automated actions, or third-party outputs will always be complete, current, or accurate.

Limitation of liability

To the fullest extent permitted by law, Madrina will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business interruption arising from the Services. Madrina’s total liability for claims related to the Services will not exceed the greater of the amount you paid Madrina for the Services during the 12 months before the event giving rise to the claim or US$100.

Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you.

General terms

If any provision is unenforceable, the remaining provisions remain effective. A failure to enforce a provision is not a waiver. You may not transfer this agreement without our consent; Madrina may transfer it as part of a merger, acquisition, reorganization, or sale of assets. These terms, together with the Privacy Policy and terms shown at purchase, are the entire agreement about the Services.
